Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("Customer", "you") and Umall Pty Ltd (ABN 19 607 555 331) ("we", "us", "our") governing your use of Roster Pro, accessible at roster.easyworks.app ("Service"). By creating an account or using the Service, you agree to these Terms.

1. Service Description

Roster Pro is a cloud-based staff scheduling and payroll reporting tool designed for small Australian cafe and retail businesses. The Service allows you to create rosters, track hours, generate payroll summaries, and export data.

2. Eligibility

You must be at least 18 years old and operating a legitimate business to use the Service. By accepting these Terms, you represent that you have the authority to bind your business to this agreement.

New accounts receive a 30-day free trial with full access to all features. No credit card is required during the trial. At the end of the trial, access to paid features will require a subscription.

6. Refund Policy

We do not offer refunds for partial subscription periods, except as required by the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)). If you believe you are entitled to a remedy under Australian Consumer Law, please contact us.

7. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot be excluded or limited.

9. Data Ownership and Licence

You retain ownership of all data you upload to the Service ("Customer Data"). You grant us a limited, non-exclusive licence to host, process, and transmit Customer Data solely to provide the Service. We will not access your Customer Data except to provide and support the Service, or as required by law.

10. Liability Limitation

To the maximum extent permitted by law, our total liability to you for any loss or damage arising out of or in connection with the Service (whether in contract, tort, or otherwise) is limited to the amounts you paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, consequential, or special damages.

11. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising out of your use of the Service, your breach of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your account immediately if you breach these Terms or if we reasonably believe your use poses a legal or security risk. You may close your account at any time via Settings. Upon termination, your data will be retained for 90 days and then permanently deleted.

13. Changes to the Service and Terms

We may modify the Service or these Terms at any time. We will provide reasonable notice of material changes (at least 14 days) via email or in-app notification. Your continued use of the Service after the notice period constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Victoria, Australia. Any dispute that cannot be resolved informally will be submitted to the exclusive jurisdiction of the courts of Victoria.
